INDUSTRIAL DESIGNS
An industrial design encompasses a product’s overall or partial appearance resulting from the lines, contours, colors, shapes, textures, or materials of the product itself or its ornamentation. In Mexico, an industrial design registration is valid for five years and can be renewed for periods of the same duration, up to a maximum of twenty-five years.
Industrial designs can be of two types: industrial drawings (combinations of figures, lines, or colors incorporated into a product for decorative purposes, giving it a unique and distinct appearance) or industrial models (any three-dimensional shape serving as a pattern for the manufacture of a product, providing it with a special appearance without implying any technical effect).
Unlike inventions that must meet three requirements for patentability, industrial designs only need to meet the criteria of novelty and industrial application according to current regulations.
At IP Consultores, we guide registering, preserving, and renewing industrial designs before the Mexican Institute of Industrial Property (IMPI) through the management of the following procedures:
- Application for registration of industrial designs.
- Renewal of registration of industrial designs.
- Application for reinstatement of expired registration of industrial designs.
- Transformation of an application for industrial design registration into a patent or utility model application.
- Rectification of omissions from the substantive examination of industrial designs.
- Processing of Report on the validity of industrial design registrations.
