UTILITY MODELS
A utility model is any object, utensil, apparatus, or tool that presents a different function than its integrated parts or the advantages of its utility. It must result from an arrangement, configuration, structure, or form modification.
In Mexico, the validity of a utility model is fifteen years, non-renewable, as long as the corresponding annual fee is paid. Unlike inventions, according to current regulations, utility models only need to meet the requirements of novelty and industrial applicability for registration.
At IP Consultores, we guide registering, preserving, and renewing utility models before the Mexican Institute of Industrial Property (IMPI) through the management of the following procedures:
- Application for registration of utility models.
- Application for registration of a utility model under Chapter I of the Patent Cooperation Treaty (entry into the national phase).
- Application for registration of a utility model under Chapter II of the Patent Cooperation Treaty (entry into the national stage).
- Payment of the annual maintenance fee for utility models.
- Application for reinstatement of expired utility model registration.
- Transformation of an application for utility model registration into a patent or industrial design application.
- Rectification of omissions from the substantive examination of utility models.
- Processing of the Report on the validity of utility model registrations.
