If you´re in the step of your entrepreneur´s journey where you only need to obtain your trademark is because you´ve spent a lot of time and effort developing your goods or services. But if you don’t have any idea about how you could design your brand, don’t worry, at IP Consultores, we can explain to you some keys for trademark design.
- A global wave of Trademarks
Regarding the WIPO´s World IP Indicators Report 2022, 13,9 million trademark applications were filled during 2021. Asia was the geographical region with the highest trademark application rate (69,7%), while Europe reached only 15,7 %, North America at 5,9%, Latin America and the Caribbean at 5,7%, Africa at 1,6%, and Oceania at 1,3%. This data demonstrates that most trademark applications are concentrated exorbitantly in only one region worldwide.
- Different kinds of Trademarks
Nowadays, there are several kinds of trademarks on the Market. For instance, the Play-Do modeling compound´s distinctive smell, and Tiffany and Co.´s blue packaging are two of the most iconic trademarks. Furthermore, there are several Non-conventional trademarks, such as motion marks (the female statute at the opening of every Columbia Picture´s movie), hologram trademarks (American Express´ hologram for the surface of its credit card), and multimedia marks consisting of the combination of images and sounds.
- Trademark´s elements
Talking about trademark design entails knowing the different features that shaped them. Some Conventional trademarks are shaped by words and logos, and others by a single letter (the iconic M of McDonald´s or the N for Netflix).
Also, some trademarks are shaped by names, such as Lionel Messi or Carolina Herrera. Idependently of the graphical elements chosen, the distinctiveness of a brand is its most relevant feature.
- Distinctiveness
Distinguishing goods or services unequivocally is the goal of a trademark design. It´s important to emphasize that if we want to distinguish unequivocally goods or services, we will need a trademark registered. In Intellectual Property Law, the distinctiveness of trademarks is perhaps their most relevant feature.
- Professional Trademark Design
We could understand why professional trademark design is necessary if we recognize that positioning a brand in the market is fundamental for its competitiveness. For this, we´ve identified three reasons why a trademark needs to be designed by a professional: 1) distinctiveness; 2) legal requirements; and 3) design quality.
